Federal and state laws provide for the right to legal representation in cases where a person`s liberty or other constitutional interests are at stake, such as criminal proceedings and government actions to terminate the parent-child relationship. But a person is not entitled to legal representation in other areas, including divorce and custody, protection from domestic violence, eviction and foreclosure, landlord-tenant disputes, claims, contract disputes, inheritance, and elder care. Legal aid lawyers work tirelessly to help as many poor people as their limited resources allow, and private lawyers donate their services to the public pro bono – for the public good. A University of North Texas study showed that Texas lawyers provide more than two million hours of pro bono legal advice to the poor each year. Despite all these efforts, the demand for civilian services remains overwhelming. Texas legal aid providers help more than 100,000 families each year, but they estimate that three out of four qualified applicants are turned away because of lack of resources. National and other state studies predict that 80 to 90 percent of low- and middle-income Americans with civil law issues are unable to get representation. For over 30 years, Terry Jessop & Bitner has built a well-deserved reputation for providing reliable and effective legal services focused on: Justice Learned Hand remarked, “If we want to preserve our democracy, there must be one commandment: Thou shalt not ration justice.” But without access to quality legal representation, Justice Antonin Scalia found, there is no justice. The unmet need for legal services is not limited to the poorest. The middle class, which earns too much to qualify for legal aid but not enough to afford a lawyer, sometimes feels compelled to try to represent itself or give up its rights altogether.

The cost of legal services has become prohibitive for most Americans. An important factor in the cost of legal services is the increase in the cost of legal education. Law students graduate with six-figure student debt. At the same time, many new lawyers have limited employment opportunities. In short, more than ever, people need lawyers, and lawyers need work, but the cost of legal services separates them. This gap has been called the “equity gap” and is widening. The integrity of the justice system depends on our ability to shut it down. Justice only for those who can afford it is neither justice for all nor justice at all. The commission`s role is to gather information on initiatives and proposals to expand the availability of civil justice services for low- and middle-income Texans, evaluate that information, and recommend ways for the Texas Supreme Court to achieve this expansion.
